What is the benefit of hiring a lawyer to do my K1 fiance visa?

Hello. I am applying for a K1 visa for my fiancee from Mexico. The lawyer wants 2500 plus the application fees. What is the benefit of hiring a lawyer rather than doing it myself?


If you have a complicated case where either you or your fiancee has criminal convictions or if she has previously been here in the USA illegally or overstayed a visa you will need a lawyer.

If your case has no complicating factors you can do it yourself as long as you read the forms carefully and gather the evidence you need. It really is quite easy.

All a lawyer will do is proof read your forms. You will still have to gather all the evidence and wait for the lawyer to send it. All replies will go to the lawyer so things can take a little longer.

If you do decide on a lawyer please make sure he or she is properly qualified.

The benefit is really in the convenience and the understanding. You have to understand that American immigration laws are pretty difficult to someone who doesn't really understand "legalese." Also, bureacratic little things those INS people are. You could wait for hours and then make one wrong move and they deport your butt (which almost happened to my sister in law, who had already spent 5000 without an attorney).

If you have the money, I would definitely hire the lawyer.

Unless your fiance has a criminal history, or has lived illegally in the United States, there is NO benefit. It's $2,500 down the rat hole for filling out three very simple forms, gathering evidence of your relationship (phone bills, printed email messages, pictures of the two of you together, etc...) and mailing it.

Look at the forms yourself.... I-129F, I-134 and G-325A.

The attorney will know exactly what is needed and how to fill out the forms correctly. It would be done the right way. Well worth his fee to make sure it is done the right way.
